The terms "we", "us" and "our" refer to Brugs Creations, an Australian art business based in Collie, Western Australia.

Brugs Creations operates this website and online store to showcase and sell original artwork, fine art prints and other creative products, and to provide information about commissioned artwork.

Our online store is powered by Shopify.

These Terms of Service, together with our Privacy Policy, Return and Refund Policy and Shipping Policy, explain the conditions applying to your use of our website and purchases.

By accessing or using our website, you agree to these Terms of Service, subject to your rights under applicable Australian law.

Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded, including rights under the Australian Consumer Law.

Section 1 — Access and Account

You agree to provide accurate and current information when placing an order or creating a customer account.

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

You must use our website lawfully and must not access another person's account without permission.

If you are under 18, you should obtain permission from a parent or guardian before making a purchase.

Section 2 — Our Products

Brugs Creations offers original artwork, professionally produced fine art prints and, when available, other art-related products.

Our original paintings are individually created and may feature natural variations in brushwork, texture and finish.

Our museum-quality Fine Art Prints are produced to order through our professional printing and fulfilment partner, Artelo. Product descriptions specify the available sizes, materials and framing options.

Studio Prints and stickers may also be offered as our product range expands. These products will be described individually when available for purchase.

We endeavour to display accurate photographs, descriptions, measurements and product information.

Colours may appear slightly different depending on individual screen settings. However, all products must meet applicable consumer guarantees, including requirements relating to acceptable quality and matching their descriptions.

Product availability, options and pricing may change. Changes will not remove rights arising from orders already accepted.

Section 3 — Orders and Cancellations

When you submit an order, you are offering to purchase the selected products.

We may decline an order where there is a genuine reason, including unavailable stock, an inability to fulfil the order or a material pricing error. Where payment has been collected for an order we cannot supply, we will provide an appropriate refund or other remedy in accordance with applicable law.

After placing an order, you will receive an email confirming the order details.

Fine Art Prints are made to order. Production may begin shortly after an order is accepted.

If you need to request a change or cancellation, please contact us promptly at brugscreations@gmail.com.

We cannot guarantee that a change-of-mind cancellation can be accommodated after production begins.

Your rights under Australian Consumer Law remain unaffected.

Section 4 — Prices, Payments and Taxes

Unless otherwise stated, prices displayed on our Australian website are in Australian dollars (AUD).

Brugs Creations is not currently registered for Goods and Services Tax (GST). Accordingly, we do not charge GST on our sales while we remain unregistered.

If our GST registration status changes, we will update our pricing and tax information as required.

Applicable shipping charges and any other additional costs will be displayed before you confirm your purchase.

Payments are processed using the payment methods available through our Shopify checkout.

We do not store complete payment card details on our own systems.

We reserve the right to correct genuine pricing errors, subject to applicable law and the rights of customers with existing orders.

Section 5 — Shipping and Delivery

Brugs Creations operates from Collie, Western Australia.

Our Fine Art Prints are produced and dispatched through Artelo. Other products, when available, may be packed and dispatched directly by Brugs Creations.

Products from different fulfilment locations may arrive in separate deliveries.

Delivery charges, destinations and available shipping options are determined during checkout.

Production and delivery timeframes may vary depending on the product, destination and shipping provider.

Any delivery estimates are provided in good faith but may be affected by circumstances outside our reasonable control.

If your order is delayed, missing or damaged during delivery, please contact us so we can investigate and assist.

Brugs Creations remains responsible for meeting its obligations as the seller under Australian Consumer Law, including applicable obligations relating to delivery and product quality.

Section 6 — Intellectual Property and Artwork Copyright

All original artwork created by Brittanie for Brugs Creations, together with associated artwork images and original creative content, remains protected by applicable copyright law.

Purchasing an original painting, print or other physical product does not transfer copyright or reproduction rights to the purchaser.

Unless separately agreed in writing, customers may not reproduce, commercially distribute, sell copies of, license or create commercial merchandise from our artwork.

Permission must be obtained before using artwork for commercial purposes.

Website content, photographs, branding, graphics and written materials are also protected by applicable intellectual property laws, subject to the rights of their respective owners.

Nothing in this section prevents uses permitted by law.

Section 7 — Optional Third-Party Tools

Our website may provide access to features or tools operated by third parties.
